You can create as many DirectX contexts targetting which ever available specification, be it DirectX 9 or DirectX11. The issue is probably somewhere in the handling of the device context that is the window to which the game is rendered because aside from that and a hook to the game pause feature I can't think of what a game and the overlay would need to share.
